Terms and conditions

Article 1 : APPLICATION OF THE TERMS AND CONDITIONS OF SALE

Designation of the parties in these conditions is as follows:
- "The seller", "we", "our" "La Cave du Marché" refers to the company SARL MV33 - La Cave Du Marché.
- "customer", "the buyer", "you", "your" refers to the consumers, customer, buyer and/or user of the sites www.lacavedumarche.com and www.lacavedumarche.fr

It is specified beforehand that these conditions exclusively govern sales made by buyers to the seller through the following distribution channels:
- website www.lacavedumarche.com
- website www.lacavedumarche.fr
- by telephone on +33 (0)2 37 21 43 10
- by email

In the absence of specific stipulations and agreed in writing between the parties, all orders placed are automatically subject to these general conditions of sale, which prevail over any other document, such as prospectuses, press, catalogs or e-mailing issued by the Seller, which have only an indicative value, to the exclusion of all other conditions, in particular those in force for in-store sales.

Upon validation of an order, the buyer (hereinafter the customer(s) or buyer(s)) declares to have consulted and undertakes to accept and respect all of these general conditions here present.
In accordance with article L3342-1 and L3353-3 of the Public Health Code, when validating his order, the buyer certifies that he is over 18 years old.

Article 2: PRICING

Prices are expressed in Euros.
They are displayed on the site in two forms:
- All taxes included: "€ TTC"
- Excluding VAT: "€ HT"
These prices exclude processing costs (packing and making the package), shipping and any other ancillary service (insurance, product return guarantee, etc.).
These services are invoiced at the end of the order, before its validation.

Our prices are subject to sale, without commitment, subject to available stocks.

In the event of an order to a country other than metropolitan France, the buyer is the importer of the product(s) concerned. For all products shipped outside the European Union and DOM-TOM, the price will be calculated excluding taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums are not the responsibility of the seller. They will be the responsibility of the buyer and are his full responsibility, both in terms of declarations and payments to the competent authorities and/or bodies of the country of destination. The buyer is therefore strongly advised to inquire about these aspects with his local authorities.

Article 3 : ORDER

The Customer can place an order:

- on the websites of La Cave du marché
The customer builds a basket by choosing the number of products he wants. Once his selection has been made, the customer validates his basket and his method of payment.
After accepting the T&Cs, orders become final when they are validated by the product regulations.

The seller is entitled to require the customer to provide proof of identity and address (K-bis extract, intra-community VAT number for legal persons) to validate the order. In the event of refusal on the part of the customer or non-compliance of the parts, the seller may refuse and cancel the order. If the customer does not want to submit to this control, this can also cancel the order.

The seller is entitled to cancel an order if he considers that the latter presents various anomalies and irregularities. (doubts about the identity of the customers, usurpation, creation of irregular accounts etc …).

The seller is entitled to cancel an order if he finds an error in the pricing of an article.

Article 4 : AVAILABILITY

Sales are made subject to stocks actually available.
The stock status visible on the sites is updated regularly. However, this data is not displayed in real time.

Our product offers are valid as long as they are visible on the sites, within the limit of available stocks, excluding promotional operations mentioned as such on the sites. In the event of unavailability of product after placing the order, the buyer will be informed by email. The order will be automatically canceled and/or modified with the customer's agreement.

Some references may be subject to a minimum order. This particular condition is clearly specified on the sites for each of the references concerned.

Given the speculative and, or, rare nature of certain products offered by the seller, the latter reserves the right to refuse orders for the same product in large quantities and this from 2 identical items.

Article 5 : PAYMENTS

The seller provides the buyer with the following payment methods:
• Payment by Bank Cards: payment by card is secured by an online payment system with SSL standards
• PayPal
• Payment by bank transfer: you can send us a transfer through our partner bank. You will find all our bank details when ordering when choosing your method of payment.

The seller reserves the right to ask the buyer to modify a payment method for the purpose of securing the transaction. In case of refusal by the buyer, the seller reserves the right to cancel the order.

Orders will only be effective upon receipt of payment from the buyer. Any order not paid within a week may be canceled without formalities.
Upon receipt of payment, an invoice will be made available.

Full payment of the order is one of the conditions for the transfer of ownership of the goods.

Article 6 : ORDER PROCESSING AND PREPARATION

The prices displayed on the site are exclusive of the flat-rate contribution to the processing costs (packaging and making of the package).
Currently, La Cave du Marché offers these processing and order preparation fees.

Bottles of wine are shipped exclusively in specific packaging dedicated to their transport.

The original packaging can be provided on request and subject to availability.
The mention of this availability on the sites is not contractual.

Article 7 : DELIVERY

COLLECTION AT LA CAVE DU MARCHE : no charge if the collection is carried out within 60 days of your order.
After this period, storage costs will be requested from the buyer. The seller will also reserve the right to cancel the order.

TRANSPORT FEES: It is calculated according to weight, destination and applicable taxes (fuel) by our partner carrier. A price list can be sent on request. Shipping costs are exposed to the buyer before the payment stage.

RECEIPT OF GOODS: It is essential that the person receiving the order checks the contents of the shipment before signing the carrier's slip. Any anomaly (missing, breakage, deterioration) must be clearly specified on the slip with the name and quantities of the missing wines.
In the event of damage or lack of bottles noted, the customer will be required, within 24 (twenty-four) hours, to notify the seller and send him:
- 1 (one) photo of the entire package closed with the legible transport label
- 1 (one) photo of the open package taken from above
- 1 (one) photo of all the bottles received

As soon as the seller becomes aware of the dispute by fax, post or e-mail (within a week at the latest), he will compensate the buyer by returning the wines or refunding the goods.
Warning: formulas of the type "subject to unpacking" are null and void. Only the precise and detailed mention of the missing, broken or damaged items with the signature of the person who received them allows you to be entitled to a refund.

DELIVERY ADDRESS: The buyer is the sole guarantor of the accuracy of the delivery details he has provided: address and telephone number. The buyer must make sure to be present or to be represented at the time of delivery.

Article 8: WITHDRAWAL PERIOD

A withdrawal period is offered to the buyer in accordance with the provisions of Article L 121-16 of the Consumer Code. The buyer has a period of 7 days from the delivery of his order. The exchange or refund of the order will be made within 30 days of receipt of the return of the order.
The order must be returned in the original packaging accompanied by the invoice.
The shipping costs (round trip), as well as the processing costs, will be borne by the buyer.
La Cave Du Marché must be kept informed of the return of the goods by e-mail or by post.

Article 9 : LEGAL INFORMATION

In accordance with article L. 3342-1 of the Public Health Code stipulating that the sale of alcohol to minors is prohibited, the creation of an account and the order with LA CAVE DU MARCHE are strictly reserved for adults aged 18. and more.

Alcohol abuse is dangerous for health. It is to be consumed in moderation.

LA CAVE DU MARCHE undertakes to respect the confidentiality of the information provided by the buyer, which is exclusively reserved for SARL MV33 - LA CAVE DU MARCHE
Under Article 27 of Law No. 78-17 of January 6, 1978, the buyer is free to make corrections or withdraw his personal information.

Article 10 : Transfer of Ownership and Risks

Property retention clause :
The Seller remains the owner of the goods subject to the occurrence of the following events:
- receipt of payment by the seller
- departure of the goods from the seller's storage site by shipment or collection.
Thus, the transfer of Ownership takes place if and only if these two operations are carried out.
The transfer of risks takes place at the same time as the transfer of ownership.

Case of exercise of Retraction:
In the event of withdrawal, the buyer remains the owner of the goods concerned subject to the occurrence of the following events:
- good reception of the goods in return, in their initial state and noted by the seller
- payment of reimbursement by the seller
Thus, in the event of withdrawal, the transfer of Ownership takes place if and only if these two operations are carried out.
The transfer of risks takes place at the same time as the transfer of ownership.

Article 11: INFORMATION AND DESCRIPTIONS OF PRODUCTS

Visuals: the visuals used on the www.lacavedumarche.fr and www.lacavedumarche.com sites are not contractual. The final appearance of the product may be different from the illustration visuals offered on the sites.

Descriptions of the wines: La Cave Du Marché cannot be held responsible for the comments, reviews and descriptions of the wines.

Product photography: On simple request, our teams can send one or more photos of the bottles of wine offered in our catalogue.
